25. How Our Immigration Barristers Can Help
Applying for an Innovator Founder Visa is legally complex and commercially demanding. Applicants must first secure endorsement for their business proposal and then satisfy the separate immigration requirements of the route. At Richmond Chambers, our specialist immigration barristers provide strategic advice, detailed application preparation and expert legal representation throughout both stages of the process.
Innovator Founder Endorsement Advice and Representation
Whether you are developing a new business proposal, applying as part of a founding team or seeking further endorsement for an existing business, we can:
- Assess your eligibility under the Immigration Rules and advise on the strengths and weaknesses of your proposed application;
- Advise on the most appropriate endorsing body for your business and circumstances;
- Review your business plan against the innovation, viability and scalability requirements;
- Identify and address weaknesses in your market research, financial projections, funding evidence or proposed operating model;
- Advise on how to demonstrate your personal contribution to the business idea and your intended day-to-day role;
- Prepare or review your endorsement application forms, supporting documents and written representations;
- Prepare you for any endorsement interview and advise on further information requested by the endorsing body;
- Act as your representative in correspondence with the endorsing body until a decision is reached.
Our approach is strategic and evidence-led, with the aim of presenting a coherent application that addresses both the formal endorsement requirements and the practical concerns likely to arise during assessment.
Innovator Founder Visa Applications
Following a successful endorsement, we can assist with the separate Innovator Founder Visa application to the Home Office. This includes:
- Confirming that the endorsement letter meets the requirements of the Immigration Rules and remains valid for the proposed application;
- Advising on the English language, maintenance, suitability and supporting-document requirements;
- Preparing the online application and reviewing the evidence for accuracy and consistency;
- Drafting detailed legal representations in support of the application;
- Identifying and resolving any issues arising from the applicant’s immigration history or personal circumstances;
- Advising on applications by dependent partners and children.
We ensure that the immigration application is consistent with the endorsed business proposal and is submitted within the validity period of the endorsement letter.
Extensions, Contact Points and Settlement
We also advise and assist Innovator Founders throughout their period of permission, including with:
- Preparing for mandatory contact point meetings with the endorsing body;
- Responding to concerns about progress against the endorsed business plan;
- Applications for further endorsement and extension of permission;
- Endorsement applications based on the same business or, where appropriate, a new business proposal;
- Planning for settlement from an early stage;
- Applications for indefinite leave to remain after three years in the Innovator Founder route;
- Evidencing investment, job creation, customer growth, revenue, exports, research and development or intellectual property activity;
- Advising founding teams on the allocation of settlement criteria where several applicants rely on the same business.
Early advice can help ensure that commercial records, immigration compliance and business development remain aligned with the requirements for extension and settlement.
Endorsement Refusals, Withdrawal and Visa Refusals
If your endorsement application has been refused, your endorsement has been withdrawn or your Innovator Founder Visa application has been refused, our immigration barristers can:
- Review the reasons for the adverse decision and advise on the available options;
- Advise on any review, reconsideration or appeal process offered by the endorsing body;
- Assist with a fresh endorsement application or an application to another suitable endorsing body;
- Advise on the immigration consequences of endorsement withdrawal;
- Respond to a proposed cancellation or curtailment of permission;
- Advise on administrative review or any other available challenge to a Home Office decision;
- Prepare a revised application supported by further evidence and legal submissions.
We provide clear and urgent advice where endorsement withdrawal or cancellation of existing permission may affect an applicant’s ability to remain in the UK.
Whatever stage you are at in the Innovator Founder process, our immigration barristers offer clear, dependable legal advice and high-quality representation from initial business assessment through to endorsement, visa approval, extension and settlement.
